9. What are the Australian advertising and marketing code requirements?
When you joined your Finance Club affiliate marketing programs you were required to acknowledge your acceptance and agreement to each of the conditions stated. An important condition is that the guidelines for advertising are for the affiliates general assistance and do not constitute legal advice on their own specific circumstances and advertising.
Overall Impression:
An affiliate must not deceive or mislead consumers and take great
care to ensure advertising is not ambiguous with claims and statements.
This requirement covers websites and all advertising offline and online.
Detailed guidelines are covered under the relevant sections of the Australian
Consumer Protection and Trade Practices codes governing advertising.
Audience :
The target audience of an advertising campaign may be different
to the actual audience that receives the message. Members of the audience
may be unsophisticated or have limited knowledge of the finance industry.
Care must be taken to avoid misleading your potential audience.
Intent :
Advertising may be found to be misleading or deceptive irrespective
of wether you had any intention to mislead or deceive at all. You need to
put yourself in the receivers position and be objective.
Risks to Avoid:
Specific to the Australian Finance industry advertising you need
to carefully check for accuracy and truthfulness, particularly if you use
the following words:
"Independent", "Impartial", "Unbiased Advice", "Best", "Guaranteed", "Free" We recommend you do not use these words, there are many alternative statements that you can use to gain attention.
If you use comparative advertising, always ensure the claims being made about competing products are accurate.
If you have any questions about setting this up, please use our Help Desk and we will assist you. Be sure to select the Finance category when making an enquiry.
